Flexilis Forestry LLC started in August 2017. Joe Reddan had just retired from the USDA Forest Service after a 40+ year career that began in South Fork, Colorado. South West Colorado and Northern New Mexico have abundant private forest lands where consulting forestry management advice could make a difference for the property owner and their neighbors.

WHAT CAN YOU EXPECT
from a Consulting Forester
A Consulting Forester is an independent professional who assists forest landowners in the management of their forests.
To help forest landowners achieve the goals and objectives for their forested property, the Consulting Forester uses their knowledge of: forest science, forest ecology, wildlife biology, soil science, local markets and contractors, forest landowner assistance programs and most importantly, forest landowner client’s desires and values for successful forest conservation outcomes.
Consulting Foresters are fiduciaries. Investment in forest land is an opportunity and as with any opportunity that investment can devolve into a cost. Just as with investments in mutual funds, stocks, bonds and other market investments, forest land ownership can yield gains or losses for the owner investor. The Consulting Forester serving as a fiduciary, has an obligation of specific duties to the person or persons who they are representing. These specific fiduciary duties include:

Loyalty is the most fundamental fiduciary duty a Consulting Forester owes to the Principal. The duty obligates the Consulting Forester to act at all times, solely in the best interests of the Principal, excluding all other interests.

A Consulting Forester is obligated to promptly and efficiently obey all lawful instructions of the Principal that conform to the purpose of the agency relationship. However, the duty does not include an obligation to obey unlawful instructions, such as instructions to not comply with Colorado State Best Management Practices.

A Consulting Forester must disclose to the Principal all known relevant and material information that pertains to the scope of the agency. The duty includes any facts affecting the value or desirability of the forested property.

A Consulting Forester is obligated to safeguard his/her Principal’s lawful confidences and secrets. Therefore, any request for information about the Principal’s forested property would not be shared with any third party without the written consent of the Principal.

A Consulting Forester is obligated to use reasonable care and diligence when pursuing the Principal’s affairs. The standard of care expected of a Principal’s Consulting Forester is that of a competent forest and natural resource management professional. By reason of their qualifications and experience, the Consulting Forester is considered to have skill and expertise in forest land management matters superior to that of the average person.

A Consulting Forester is obligated to account for all money or property that belongs to his/her Principal entrusted to that agent. The duty compels a Consulting Forester to safeguard any money, deeds, or other documents entrusted to them relative to their client’s transactions of affairs.
